These General Terms and Conditions govern the legal relationship between HOTEL BOHEMIA SUITES & SPA (hereinafter referred to as “Bohemia”), hotel belonging to RESIDENCIAS CANARIAS, S.A., a legally constituted Spanish company based in Avenida Estados Unidos, 28, San Bartolomé de Tirajana, 35100, Las Palmas de Gran Canaria, Spain, and holder of the tax identification code (C.I.F) A28191401, and the final Customers who book all services provided by Bohemia (hereinafter referred to as “Customers”, “you” or “your”). In particular, the Booking of rooms, restoration services and/or any other experiences related to the range of services provided by Bohemia (hereinafter referred to as “Services”) are subject to the acceptance of the General Terms & Conditions herein. Bohemia will make any developments or changes to the information, data, services, and other materials provided on the Website, at any time without notice. Bohemia shall also change these Terms and Conditions at any time, and any such modification shall be effective immediately upon the posting of the modified Terms on the Website. In consequence, if you continue to use or access to this Website you are indicating your acceptance of the modified Terms and Conditions. Bohemia may suspend access to this Website, due to maintenance works, net security or any other cause, with no obligation to reimburse or compensate you for the period in which access was suspended.
This Website allows the Customers to book the Services provided by Bohemia, in the conditions detailed for each booking (hereinafter referred to as “Booking”). It is compulsory that you accept these General Terms and Conditions to make any Booking through our Website. Through the Booking process, the Customers accept that the present General Terms and Conditions are binding. In this regard, Bohemia will not accept any non-binding reservations.
Customers making any Booking on the Website must follow the Booking instructions. During the Booking, you will be asked to provide your personal information (i.e. your name, surname, email address and credit/debit card details). You shall be liable that the information provided is correct and accurate up to date. In this sense, any data received by Bohemia will be treated in compliance with European Regulation (EU) 2016/679, of April 27, 2016 on the protection of natural persons with regards to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) and will be used exclusively to process Booking and payment of the Services, to which you expressly consent. Furthermore, you will be asked to provide information necessary to make the payment, which will have to be made by credit or debit card through a secure payment gateway, that ensures the encryption of the transactions.
By accessing and using this platform, you agree that you are on legal age and have full legal capacity and sufficient authorisation to make Bookings. Bookings of any type made through the Website by under-age persons will not be accepted, unless formally authorized by the relevant parents or legal guardians.
Upon carrying out the Booking, you confirm that all persons named in the Booking have accepted the present Terms and Conditions and you will assume all responsibility regarding this aspect.
Bohemia´s rates for the Services are quoted as total amounts, unless another condition is specified. All prices are quoted included VAT. Prices are subject to change without any prior notice.
Please note that the services can only be used by the person (s) identified in the Booking or by the person who made the purchase on the Website. These Services are non-transferable to another person, unless previously agreed with and expressly authorised by Bohemia.
All modifications in your Booking once accepted by Bohemia, are subject to availability as well as an applicable fee, which will be charged to your provided credit or debit card. Any modifications shall be communicated to Bohemia as soon as possible in order to include this modification in your reservation, if possible.
Cancellations must be made through Bohemia Website and are legally binding upon confirmation by Bohemia. Notifications of cancellations must be made within the cancellation period stated for the contracted Service to avoid the penalty stated in the booked offer or rate. In case the reservation was confirmed with the condition of a refundable deposit within a certain cancellation period and the deposit needs to be refunded or in case of any agreed refund, administrative expenses equal to 8% of the total amount of the deposit amount will be deducted from this transaction.
It is at Bohemia´s sole discretion to cancel the Services confirmed due to force majeure, meteorological hazard, official measures, act of terrorism, strikes, global or national pandemic, or similar unforeseeable events. In such cases, Bohemia will not be liable for any changes or cancellations effected on your Booking, or for any loss or damage suffered by you arising from any failure by Bohemia to properly perform any of our respective obligations to you.
During your Booking through the Website, the full amount of the Services will be deducted from your credit or debit card, either as capture or as a blockage in terms of a preauthorization. Bookings will only be valid if the corresponding payment or reservation guarantee has been processed correctly. Payment transactions on Bohemia’s Website are encrypted by a secure payment system. This technically secured environment ensures that credit card details cannot be intercepted and are not revealed to anyone other than to financial institutions required to process payment instructions from the customer.
Our payment system accepts the payment methods listed in the payment step. Payments through bank transfer are subject to the SEPA direct debit procedure. The transaction will appear in your credit card statement as Bohemia Suites & Spa as the merchant of the record. The Payment will be made through the payment gateway Worldline.

Bohemia´s insurance does not include Customers as additional insured. In this regard, you are urged to take out a valid travel insurance which should cover any personal losses and all medical costs in the event of an accident or illness during your trip.
In the event you have any complaint or problems with the Services rendered by Bohemia, you must inform us as soon as possible, in order to take an adequate action to solve the complaint.
Customer´s claims against Bohemia due to non-fulfilment or fulfilment not in accordance with the contract must be made asserted within 30 days after the date of the Services in writing with a detailed explanation of the claims. Claims received by Bohemia after expiry of this deadline cannot be accepted anymore, except if Customers prove that they were faultlessly prevented from meeting such deadline.
Bohemia will not be responsible for any damage or actions, omissions or negligence by any third party.
The services and all materials and content available on the website are provided “as is” and bohemia expressly disclaims any and all other representations and warranties, including any implied warranty of merchantability, fitness for a particular purpose of the customer, even if they have been communicated to bohemia. bohemia expressly disclaims any warranty regarding the functioning of the platform withouth any interruption, bug or viruses.
Customers make the relevant Booking through this Website at their own risk. Any liability of Bohemia is limited to the Services price as well as any direct damages caused wilfully or by gross negligence by Bohemia. Bohemia's liability for slight negligence, consequential damages and lost profit is excluded. Bohemia does not assume any liability in case of non-fulfilment of contractual obligations that results from omissions or contract violation by the Customer. Bohemia does not assume any liability for the disappearance of personal items, cash, valuables, luggage, etc. during your stay in Bohemia, as well as loss, theft, damage or misuse of checks and credit cards.
Bohemia does not assume any liability for damages based on circumstances that are beyond Bohemia's control, such as force majeure, natural events, catastrophes, global or national pandemic, or any similar unforeseeable events.
In case any of the provisions of these General Terms and Conditions shall be held or become invalid, void or unenforceable in any other way, the validity of the remaining provisions shall not be affected thereby. In case of unenforceability of a provision, such provision shall be replaced by an enforceable provision that reflects the intention and purpose of the invalid provision as closely as possible.
Bohemia reserves its rights to assign in total or in part the obligation or rights of these Terms to any third party. In this regard, the parties agree that the Customers may not assign part or all of this Terms and Conditions to any third party without prior written authorization of Bohemia.
Customers agree that their personal information, in particular, Customer´s name, telephone number, birth date, e-mail addresses, address, ID or passport, gender, credit card details or any other data related to you that may be relevant to conclude your reservation are collected by Bohemia for the purpose of carrying out the Services according to these Terms and Conditions and in compliance with European Regulation (EU) 2016/679, of April 27, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. These Terms and Conditions shall be governed by and construed in accordance with the Law generally applicable in Spain. For any dispute arising for the interpretation or execution of these Terms and Conditions, the parties expressly waiving their own jurisdiction, submit to the competence and jurisdiction of the Courts of Las Palmas, Spain.
